Josh Shapiro’s order does not reject data-center investment outright. It makes the builder’s power plan and local support central tests as states confront the costs of AI infrastructure.

Pennsylvania’s new rules could make AI infrastructure projects slower and more expensive by requiring developers to supply their own power, absorb grid-related costs, undergo intensive environmental and community review, and secure municipal approval. The policy follows a $20 billion Amazon investment and growing local resistance to data centers. It also creates a test for whether states can accommodate AI expansion without shifting infrastructure costs to ratepayers.
Pennsylvania’s order targets grid-cost allocation, requiring developers—not electricity customers—to cover power infrastructure tied to new centers.
The policy follows Amazon’s planned $20 billion investment in two Pennsylvania data centers.
Lawmakers in 15 states have considered moratoriums; roughly 75 opposed projects worth $130 billion faced resistance in Q1 2026.
Pennsylvania is placing a new set of conditions on data-center development, putting electricity supply, local consent and community impacts at the center of a sector being pushed to build quickly for AI demand. Gov. Josh Shapiro has signed an executive order imposing new requirements on large data centers in the state.
The order marks a change in emphasis for Shapiro. Last year, he helped secure a $20 billion Amazon investment for two Pennsylvania data centers. He now says conversations with constituents showed him that some developers were disregarding nearby residents and advancing speculative proposals that disrupt communities.
Shapiro’s stated distinction is not between all projects and none. He said Pennsylvania remains open to serious proposals with local backing that protect the environment and generate power, while rejecting developers he says are trying to force projects through over community objections.
One intended effect is to shift the cost of grid demands from electricity customers to developers. That makes the order a cost-allocation policy as well as a land-use policy: the state is trying to keep the infrastructure burden created by a project with the company pursuing it.
The contrast with Washington is real, but not complete. Trump has promoted faster AI infrastructure construction and has also highlighted company-built power plants. In March, Amazon, Google, Meta, Microsoft, OpenAI, Oracle and xAI signed the White House’s Ratepayer Protection Pledge, agreeing to pay for the new generation and infrastructure their data centers require.
The difference is in the governing frame. Trump’s message emphasizes the economic upside of welcoming projects. Pennsylvania’s order adds a state-level screen focused on the power-system costs and local consequences that can accompany them.
Pennsylvania is entering a wider state-level fight over data-center growth. Lawmakers in 15 states have considered development moratoriums, while at least 75 data centers valued at roughly $130 billion faced local opposition in the first quarter of 2026. Electricity costs, water use and other environmental effects have helped fuel that resistance.
For developers, the practical question is whether Pennsylvania’s standards become a predictable route for well-supported projects or a higher barrier to building. The answer will turn on how the order is applied to individual proposals and whether companies can satisfy its power and municipal conditions without passing new grid costs to customers.
Editorial analysis
Pennsylvania’s move is notable less as a halt to AI infrastructure than as an attempt to change its bargain. Developers can still make a case, but the state is putting the burden of power and local legitimacy closer to the project itself. The next concrete test is whether proposed campuses arrive with credible generation plans and municipal backing, rather than treating grid upgrades and community acceptance as problems to solve after a site is chosen. That tension will shape whether this becomes a workable permitting model or a tougher screening mechanism.
