Pritzker Creates Illinois AI Cabinet to Weigh Safety Rules and Data-Center Conditions

Illinois is setting up a state AI cabinet that could shape how it prepares for AI-related incidents and how it uses its own regulatory and purchasing power. Governor JB Pritzker’s new executive order directs the group to examine safeguards for public infrastructure and potential accountability policies, including conditions on data-center incentives and a strict-liability approach to AI-caused harm.

Pritzker signed Executive Order 2026-07 on September 22, establishing the Illinois Artificial Intelligence Cabinet. Its immediate job is advisory: give state government cross-sector guidance on AI safety, risk management and regulation, while developing policies and procedures to prevent, prepare for and respond to AI incidents affecting residents.

A cabinet built around public systems

The order places AI in the context of state operations, not only technology-company conduct. The cabinet is to consider protections for public buildings, water systems, education systems and information infrastructure from AI-driven threats. Senior leaders from agencies spanning technology, emergency management, utilities, public safety, environmental protection and other functions will participate alongside outside specialists.

The questions Illinois has put on the table

• Whether data-center tax incentives, permits or operating approvals should be conditioned on safety, accountability and transparency standards.
• How AI data centers affect Illinois’s electric grid and ratepayers, including through PJM Interconnection.
• Whether AI safety and accountability standards should be incorporated into state procurement and contracting.
• Whether strict liability is an appropriate way to hold AI companies accountable for AI-caused harm.

Policy options before appointments

The cabinet’s membership is still to come. Pritzker said he will seek input from state agency leaders and announce appointees in the coming weeks. The intended mix includes people from academia, law, ethics, governance, industry and other fields, making the membership choices consequential to which risks and remedies receive the most attention.

The new cabinet follows Illinois’s Artificial Intelligence Safety Measures Act, which the administration says put risk-identification, disclosure and mitigation duties on the state’s largest AI developers. The announcement says that framework includes annual independent third-party audits and protections for workers who report safety concerns. The cabinet adds a forum for considering the state’s own infrastructure, economic incentives and contracts alongside those developer-focused requirements.

That leaves the central practical question unanswered: which recommendations, if any, Illinois will turn into binding policy. For now, the order creates a place to weigh competing goals—preparedness and accountability on one side, and the feasibility and effects of new state conditions on the other.
