AI data center expansion is running into a new practical limit: communities and state governments are slowing projects over land, water, electricity and local-cost concerns. The consequence is already visible in moratoriums, permitting constraints and a court-ordered halt on authorization to use water from a new well for one planned New Mexico complex.

The opposition is notable less for a single national position than for who has joined it. Conservative farmers and environmental advocates have aligned in Nebraska, while residents and officials in states including Texas, Wyoming, Pennsylvania, New Mexico and New York have raised concerns about data-center proposals. Their objections span farmland conversion, water availability, grid strain, pollution, noise and electricity bills.

The restrictions are no longer hypothetical

Cass County, Nebraska, approved a 12-month moratorium on data center development. The measure may pause Tenaska’s effort to potentially option more than 1,300 acres near Murray and Beaver Lake; Tenaska says it is assessing power generation for large loads, which could include a data center or other economic development.

Elsewhere, New York Gov. Kathy Hochul ordered a one-year ban on large data centers, citing grid protection. Texas Gov. Greg Abbott halted approvals of new data centers pending audits of their effects on the state electrical grid. Pennsylvania Gov. Josh Shapiro said projects that do not meet certain standards will no longer receive priority for construction permits or tax exemptions.

Water has become a legal choke point

The sharpest current example is Oracle’s planned Project Jupiter, a data center complex near the Mexican border in New Mexico estimated at $165 billion. The project has drawn concern over water supplies, and the Center for Biological Diversity challenged approval for well drilling intended to supply construction water.

The New Mexico Supreme Court granted an emergency request to halt authorization to use water from a new well until that fight is resolved. Oracle has pledged $50 million for water and wastewater systems in Doña Ana County and says the campus is designed to use little water over 15 years through closed-loop cooling and fuel-cell systems; those are company commitments and design claims, not an operating record.

The permitting fight changes the AI buildout

The clash does not amount to a unified rejection of data centers. CyrusOne, for example, controls nearly 400 acres outside Plattsmouth, Nebraska, but no development has occurred and the company has announced no project. Some local landowners have accepted large checks; residents say local land typically sells for about $10,000 an acre, while developers sometimes offer four times that amount or more.

What remains unresolved is whether developers can make credible, locally acceptable arrangements for power, water and community costs while preserving the jobs-and-revenue case supporters promote. The policy actions now underway put those questions into the permitting process rather than leaving them to broad arguments about AI’s economic promise.
